TAKE NOTE:
–ALL sketch commissions are just SKETCHES, but sometimes I accidentally do go overboard (unable to control my habits: being detailed and drawing cleanly). PLEASE, do not expect (or request) a clean or detailed sketch.
–These are for your personal entertainment only! All commercial (profit, distribution, etc) rights belong to me alone. Filling out the form and sending payment acts as your contractual agreement to these terms.

Characo sketch FAQ:

May I request specifics that aren’t available on the online form (provide links, request a specific facial structure, etc)?
NO. Please don’t ask or try to find loop holes. Characos are limited to exactly what is allowed in the online form. You do not pick any specifics beyond what options you hav on the form. This service is meant to give me 90% of the creative freedom; If you are uncomfortable with that, then feel free to look at my other services. PLEASE don’t ask for anything that will disobey what the online form allows. If something isn’t mentioned, then it’s obviously not allowed.

What are my rights to the design?
More info below, but to summarize; You’re free to use the design as your own for personal (non-profit) entertainment. I retain all rights (profit, publication, mass production, etc) for the base design and any resulting design that I, Jainai Jeffries, believe are LESS than 70% different from my base design. I encourage you to use this design as a jump off point for a design of your own; which I, Jainai Jeffries, must agree is MORE than 70% different than the original for you to retain all rights for yourself (though mentioning me as your base would be appreciated). You must get my verdict on the resulting new design before you use it for  a commercial endeavors.

I don’t own the full rights, so what do I do if I want to use your original design for a commercial endeavor?
You may lease the character from me for a period of time, then renew said contract when needed. Each leasing term will involve a contract and a leasing fee (determined after I review your proposed project with the character) before you may take hold of the rights. You can only ask for a leasing agreement for the character you purchased yourself. I CANNOT lease out a character you did not purchase, it is in your best interest to NEVER ask such a thing from me.

Concerning Character copyright

All rights are shared except for commercial/profit rights: which are exclusive to myself.

So feel free to modify or anything else you do with your other characters. The characo is made for you to own for personal entertainment only. You  do not own the rights to use the given design for commercial (profitable) reasons of any kind. If you do re-draw them or have another artist draw them, please feel free to send me a link if it’s no trouble. I would love to see whatever reincarnations are made 🙂

If you want to own all the rights (Example: if you want to use it in a comic without signing a leasing contract with me), then you must develop the characo design into a character that I, Jainai Jeffries, believe is at least 70% different than the original. Filling out the form and sending payment acts as your full agreement to these terms.

  1. Do you allow a character reference for the characo sketch? If even just for a vague facial structure? Or is that considered to be overly specific for the services offered?

    • No. You cannot request anything/ provide anything, which goes beyond the limits set in the online form. I’m sorry I didn’t provide the specifics on that (though I just added it right now for future viewers). If it’s not an available option on the online form, then it’s safe to assume it’s simply not available.

Feel free to request specifics in my other services though (as long as it fits the set perimeters of course).

      • Thank you for the feedback. I’ll spend some time looking over the alternative options for commissions. Hopefully we will be able to work something out that’s cozy for the both of us!

    • If there was such an option, you would see it. If you don’t see an option, it’s safe to assume I don’t have it available for a reason 🙂

You mean, why don’t I offer such an option? Because essentially, I would have to design and draw two different characters. I prefer my policy to remain one character per one order.

And plus, it’s more organized for me if they are kept separate. So please feel free to simply fill the form out twice 🙂

  2. I put artist’s choice on gender but had to choose one for the google cart. Are you going to get the original questionnaire along with the payment so you can see the options chosen there?

    • I’m very sorry. It was my oversight when I set up google checkout (been fixed now though). You don’t have to worry, I’ll always just go by the order form. Thank you so very much for letting me know! It’s a fairly new system, so may take a while to work out all the little kinks. Have a nice day! I should finalize your charge within 7 days, then the deadline will begin.
