My position on the new policy (G)
So, there seems to be some controversy over FA not allowing any porn of characters that even appear underage anymore, and that's causing some anger. Honestly, I don't understand how people can even try to defend it. You all know that you're only claiming your character is 18 to try to slip them under the RADAR. Certainly, some women are petite, and some fantasy races are especially so, but there comes a point where you have to look at your character design and just know that they don't look like an adult.
And that's where a lot of people's misunderstandings seem to come from. The law doesn't give a damn how old you claim they are. If you make an obviously-underage character, the law will treat them as a minor, even if your story claims that they're really 1,000 years old, or what have you. It's indefensible, and regardless of what you say publicly, if you don't understand that deep down inside, you're lying to yourself.
And that brings me to my biggest reason for supporting FA on this. Because while I do also look at such content (within limits), I also understand that it's wrong. It's an unhealthy paraphilia, one which I deal with by sticking to fictional characters. But to complain about a site deciding that they no longer want to host such content is the height of entitlement. Nobody owes you the "right" to show or look at illegal content. There are plenty of other places out there where you can still host it. But FA says not here.
And I'm okay with that, especially since I understand the risk they're taking on by allowing it. Because they moderate the content on this website, they are legally liable for it. All of it. And that means that if the government decided to crack down on them someday, they would have no defense. In all likelihood, they chose to ban any content that even appears to contain underage characters because they don't want to go to jail or get fined or get shut down, and not because "They think they know better than the artists" about how old their characters are. It's honestly an easily understandable position, if you think about it rationally.
The only objection I have is something pointed out to me by DarkMirage, whom I am otherwise strongly in disagreement with. He said that FA will still allow things like underage vore and other such fetish art. While it isn't explicitly pornographic, I feel like if you're banning content to adhere to the law, it should be all-or-nothing. There's an argument to be made that such content violates the law anyways, even if it doesn't contain any nudity, since it is widely understood to be fetish art.
