APPLICATION FOR PROBATION
The Accused-applicant, by counsel and unto this Honorable Court,
respectfully applies for probation under the provisions of Presidential
Decree No. 968 as amended (the “Probation Law”) and states that:
1. Accused-applicant is of legal age and residing

2. On xxxx, Accused-applicant was convicted of xxxxxxxxxx, as
amended, by this Honorable Court and sentenced to suffer the penalty of
xxxxxxxxx.
3. Pending the application for any post-remedies on the
aforesaid judgment, the Accused-appellant was granted by the Honorable
Court provisional liberty under the same cash bond issued for the instant
case.
4. The Accused-applicant, through counsel, respectfully
manifests his intention to avail the benefits of the Probation Law.
5. The Accused-appellant respectfully manifests that he has all
the qualifications and none of the disqualifications to avail of the benefits
of the Probation Law, to wit:
(a) The crime for which the accused was convicted is not an
offense against the national security or public order;
(b) Accused-applicant has not been previously convicted by
final judgement of any offense punished by imprisonment
of not less than one (1) month and one (1) day and/or fine
of not less than Php200.00; and

(c) Accused-applicant has not been once placed on probation
under the provisions of the Probation Law.
6. The Accused-appellant undertakes to comply with such terms
and conditions as this Honorable Court may impose if his application for
probation will be granted.
7. Based on the foregoing, Accused-applicant respectfully moves
that the Honorable Court approve the instant application because he has
all the qualifications and none of the disqualifications to avail of the
benefits of the Probation Law.
PRAYER
WHEREFORE, premises considered, it is most respectfully prayed of
this Honorable Court that the application for Probation be referred to the
Parole and Probation Officer of Makati City for the requisite post-sentence
investigation and thereafter, the application for probation be approved.
Other reliefs just and equitable in the premises are likewise sought.
