EMPLOYMENT CONTRACT

This contract of employment is entered into and between:

ABC COMPAN (referred to as the company) represented by MR. ARNEL DELA PENA and
__________________________________ (employee)

Whereas, the Company with its office address at Sitio San Pedro, Puerto Princesa City is employing
the service of the Employee on the following terms and conditions:

1. Designation, Employment Terms & Conditions


1.1 Official Commencement and Designation
The Employee’s official start date is __________ and the Official Designation is ___________.

1.2 Probation & confirmation


You will be required to serve a 3-month probationary period to assess your performance
and suitability for continuous employment. At the end of your probation, you shall meet with
the Management of The Company to discuss extending your contract to full employment.

1.3 Termination of employment


The contract of employment may be terminated by the Company or the staff through a
written notice by the schedule provided in your contract.

2. Working Hours
3.1 The office working hours are from 8:00 am to 5:00 pm with 1-hour lunch break. The official
working hours may differ from staff to staff as this will be subject to fieldwork as determined
by The Company and discussed with the team.
3.2 The staff records the daily attendance daily time record card and logbook.
3.3 The Employee will have a 1 day-off in a week, which will every Sunday.

3. Salary & Incentives


3.1 Salary Rate and Allowances
The employee is referred as “Monthly-Paid Employee” with Monthly Salary of Twenty-
thousand (20,000).

Entitled to:
1. Incentive Bonus – The employee is entitled to receive an incentive bonus if the
company meet its target sales.
2. 1 Free Meal

*Monthly-paid employee are those who are paid every day of the month, including unworked rest
days, special days and regular holidays

3.2 Pay period & payday


The pay period is 15 days - from the 1st to the 15th day and the 16th to the 30th day of the
calendar month. Your payday will be every 20 th day of the month and on the 5th day of the
following month. Should the 5 th or the 20th day fall on Sundays, salary shall be released on
the next working day.

3.3 Overtime
Overtime is compensated, if such overtime is requested by The Company and rendered at
least two (2) hours, subject to additional compensation equivalent to regular wage plus at a

certain percent as required by law. No overtime shall be rendered without the approval of
the company especially those which are rendered on holidays and rest days.

3.4 SSS, PAGIBIG and Philhealth


Mandatory government contributions such as SSS, Philhealth and PAGIBIG will be deducted
from employee’s salary. She is hereby required to submit her SSS, PAGIBIG and Philhealth
numbers within the first month of her work. Failure to do so will be ground for not extending
her employment.

4. Salary Plan
4.1 Salary structure

Probationary Period: The employee is given three (3) months’ probation wherein he/she
received a salary set by the company. The company will assess the employee’s performance
during this period and will be the basis if he/she will continue with his employment or not.

4.2 Salary review


An annual salary review exercise will be conducted. Staff’s annual increment is performance
based. A possible increase in salary of an employee if he/she met the qualifications set by
the company.

4.3 Promotion
The Company takes an interest in your career advancement and provides opportunities for
suitable staff who meet the job requirements to be promoted to a higher level. Essentially,
we want you to learn and grow in accordance with company plans and your interest.

4.4 Resignation
Since The Company is investing time and value for the job training of employees during their
course of employment, they are encourage to stay with the company for a longer period of
time. If for some reason the employee wishes to leave or resign, he/she is required to inform
the company at least 30 days before the effectivity of resignation in order to give ample
time in hiring a new one.

5. Leaves, Absences and Leave Incentives


5.1 Leave and Leave Benefits
The following shall be strictly followed:
 Leave request for 1 to 5 days require two-week notice in advance and subject to
The Company’s approval
 Leave request for more than 5 days require one month notice in advance and
subject to The Company’s approval
 During first year of service, the company adopts the “no work, no pay” policy.
Hence, any leave availed during the period, whether sick leave or vacation leave is
not compensated.
 The Employee who has rendered at least one year of service shall be entitled to a
yearly service incentive leave of five (5) days with pay (mandatory leave).

 An employee who had rendered more than 3 years of service is entitled to 10 days leave
with pay in a year and notice of leave should be given at least 1 month before the intended
leave.
 An employee who have rendered at least 5 years of continuous service is entitled to 15
days leave with pay in a year (non-continous leave, unless approved by management).

5.2 Medical leave


- The Employee shall not be entitled to a paid sick leave during their first year of service.
However, an Employee who contracts illness after completing the one year service shall
be entitled to a paid sick leave of 5 non-consecutive days for the year, provided that the
employee shall provide a medical certificate from a Physician.
- The employee should fill up a sick leave form on the day she reported back to work after his
sick leave in order to avail the sick leave benefit.

5.5 Maternity leave and benefit

Pregnant women employees who has rendered an aggregate service of at least six (6)
months for the last twelve (12) months, shall be granted a maternity leave of at least one (1)
week prior to the expected date of delivery and another five (5) weeks after normal delivery
or miscarriage.

5.3 Retirement
- An employee upon reaching the age of sixty (60) years or more, but not beyond sixty-
five (65) years who has served at least five (5) years in the Company may retire and shall
be entitled to retirement pay subject to at least one-half (1/2) month salary for every
year of service.
- An employee who have rendered at least 10 years of service will received a separation
pay of ten thousand pesos (Php 10,000) or higher subject to the benefits set by
management.

5.2 Contract Termination


The contract may be terminated in the following instances:
 Without notice: 1) If the Employee is absent without permission for more than 3
consecutive days or over 21 days in one year of service without valid reason and
notification; 2) the employee incurs 5 consecutive tardiness/undertime without
valid reason and notification; 3) the Employee assumes a fictitious personality or
submits fake documents or certificates; 4) violates safety rules which causes
substantial financial loss to the Company; 5) convicted or proven of dishonesty; and
6) ill-disciplined or refuses to work.
 With Notice: By the Company or the Employee 30 days or less notice in writing.

6. General Rules & Regulations

6.1 Dress Code – you are expected to dress neatly to reflect professionalism. No flip-flops EVER
are allowed in the office, women may wear sandals provided they are dressy. Staff may wear
sneakers only if they are working outside. Jeans may be worn but may not have holes.

6.2 Punctuality – You are required to report for work punctually according to your scheduled
work hours. You are only allowed a 10-minute allowance or grace period but you are
required to add 10 minutes to your official time. Any tardiness/undertimes shall be
deducted from your regular salary.

6.3 Right to privacy


It is every staff’s obligation to respect each other’s right to privacy at all times. Should you
find colleagues becoming intrusive, please advise The Company.

6.4 The use of private cell phone should be kept to a minimal level during office hours and use
of Social media and other forms of internet access is not allowed unless it is work related and
with the approval of the Manager.

6.5 Dismissal
The following are some of the causes for termination (this is not a comprehensive list):
- Disclosure of confidential information obtained during the period of employment to
unauthorized parties;
- Gross and habitual neglect by the employee of his duties;
- Fraud or willful breach by the employee of the trust reposed in him by his employer or
duly authorized representative;
- Commission of a crime or offense by the employee against the person of his employer or
any immediate member of his family or his duly authorized representatives;
- Willful falsification, forgery, defacement or destruction of any Company Office records;
- Absence without authorized leave;
- Theft or misappropriation of funds;
- Willful acts resulting in endangering the life, health or safety of another person;
- Possession or use of, or trafficking of illegal drugs on the Company Office premises;
- Fighting or intimidating including provoking or instigating a fight or assault;

- Engaging in immoral or indecent or illegal acts within the Company premises or sexual
harassment;
- Conviction by any Court of Law for any criminal offence or offence;

7. Confidentiality

Confidentiality is taken seriously at The Company. In order for us to offer you a more rewarding
working experience, we must be able to trust you with important information concerning the
company’s dealings, clients, business plans and business practices.

All business dealings at The Company should be considered as confidential in nature. Any information,
business plan, concept, idea, know-how, process, program, formula, or work-in-progress, any
manufacturing, marketing, financial, or sales information, pricing or business information, or any
information regarding suppliers, clients, employees, investors, or business operations, and any other
information or materials, whether written, or graphic, or any other form or that is disclosed orally,
electronically, or any other medium, which is learned or disclosed in the course of discussions, other
work undertaken by The Company that becomes known to you shall always remain the property of
The Company. Breach of company information to an outside party for personal gain, malicious intent
or otherwise is grounds for dismissal.

That the afore-mentioned terms and conditions has been read and understood by the employee,
both the company and the employee have affixed their signatures below, to signify agreement with
this employment contract.
