The Commission on Elections, by virtue of the 1987 Constitr-rtion,
the Omnibus Election Code (OEC), Republic Acts (RA) No.7166,7941.,
9369, 11054 and other election laws, hereby RESOLVES to promulgate
the followingRULES AND REGULATIONS GOVERNING: 1)
POLITICAL CON\ENTIONS; 2) SUBMISSION OF NOMINEES OF
GROUPS OR ORGANIZATIONS PARTICIPATING UNDER THE
PARTY-LIST SYSTEM OF REPRESENTATION AND
PARLIAMENTARY SYSTEM IN THE BARMM; AND 3) FILING OF
CERTIFICATES OF CANDIDACY AND NOMINATION OF AND
ACCEPIANCE BY OFFICIAL CANDIDATES OF REGISTERED
POLITICAL PARTIES OR COALITIONS OF POLITICAL PARTIES IN
CONNECTION WITH THE MAY '12,2025 NATIONAL AND LOCAL

(BPE).

RULE I
POLITICAL CONVENTIONS AND SWORN LIST OF AUTHORIZED
SIGNATORIES WITH SPECIMEN SIGNATURES

SECTION 1. Holding of Political Conztentions. - Political parties

(PP) mav hold political conventions to nominate their official candidates
for all elective positions for the }l4ay 12,2025 National and Local Elections
(NLE) and Bangsamoro Parliamentary Elections (BPE), from September 1,
2024 (Sunday) to September 28,2024 (Saturday).

SECTION 2. hfumission of Sroorn List of Authorized Signatories

and Spechnen Signatures of Political Parties - The Chairperson or
President, or in their absence, the Secretary-General of the PP or coalition
of political parties (Coalifion) shall personally submit to the Law
Department a Sworn List of Authorized Signatories on or before
September 30, 2024 (Monday).

In case of local PP, the Sworn List of Authorized Signatories shall be

personally submitted to the Law Department and furnish a copy to the
following offices:

a. Office of the Regional Election Director (ORED), for those

registered as Regional PP;

b. Office of the Provincial Election Supervisor (OPES), for those

registered as Provincial PP; and

c. Office of the City/Municipal Election Officer (OEO), for those

registered as City/Municipal PP.

The Chairperson, President or the Secretary-General of the PP or

Coalition must show a sworn Board Resolution or Secretary's Certificate, as
proof of the formal declaration of the PP or Coalition of the authority to
submit the Sworn List of Authorized Signatories.

The Sworn List of Authorized Signatories submitted by persons other

than the Chairperson, President or Secretary-General shall be deemed as
not filed.

In case of con-flict or where there are Wvo (2) or more Swom Lists of
Authorizecl Signatories submitted by the registered PP, the Sworn List
submitted by the Chairperson or President, shall prevail.

SECTION 3. Contents of the Sworn List of Authorizeil Signatories

anil Specimen Signatures of Political Parties. - The Swom List of
Authorized Signatories shall contain the names of the authorized
signatories of the PP, including their three (3) specimen signatures,
positions in the PP and their respective jurisdiction or places of authority to
nominate and sign the Certificate of Nomination and Acceptance (CONA)
of their official candidates.

For this purpose, national authorized signatories shall refer to the

authorizec.l signatories whose jurisdiction to nominate and sign the CONA
is nationwide in scope and for national and local elective positions. Local
authorized signatories shall refer to the authorized signatories whose
jurisdiction to nominate and sign the CONA is limited to a specific place or
area and for local elective positions only.

The Sworn List of Authorized Signatories shall explicitly state whose

nomination shall prevail in case of disputes on nominations or conflicting
signatories for one (1) elective position.

The PP or Coalition shall likewise submit its contact details for

verification purposes, if needed, relative to the submission.

The Swom List of Authorized Signatories shall include the number of

pages and have the signature of the Chairperson, President or the
Secretary-General on each and every page.

The PP or Coalition shall provide their registered acronym and its

abbreviation in not more than six (6) characters taking into consideration
the thirty (30)-character limitation of the name to appear on the official
ballot.

In the event that the PP's or Coalition's registered acronym or

abbreviation exceeds six (6) characters, the PP or Coalition shall select or
provide a shortened acronym in not more than six (6) characters. If the PP
or Coalition fails to do so, the Law Department shall motu proprio
determine the acronym of the PP or Coalition for purposes of the name to
appear on the official ballot.

The form of the Sworn List of Authorized Signatories with Specimen

Signatures is attached as Annex "A".

SECTION 4. Effect of Failure to Submit Sworn List of Anthorized

Signatories toith Specimen Signatures. - Failure to submit the Sworn List
of Authorized Signatories with Specimen Signatures by the registered PP
or Coalition within the stipulated period shall result in the declaration of
their nominees as independent candidates.

The submission of the Sworn List of Authorized Signatories with

Specimen Signatures to other offices of the Commission other than the Law
Department shall likewise result in the declaration of their nominees as
independent candidates.

RULE II
PARTY-LIST REPRESENTATIVES

CERTIFICATE OF NOMINATION AND CERTIFICATE OF

ACCEPTANCE OF NOMINATION OF PARTY-LIST GROUPS

SECTION 5. Filing of Certificate of Nomination and Certificate of

Acceptance of Nonrination of Party-List Groups. - The Certificate of
Nomination and Certificate of Acceptance of Nomination (CON-CAN) of a
PP, sectoral party, organization or Coalition shall be under oath, filed in
five (5) copies in the form prescribed by the Commission and submitted to
the Law Department within the period fixed herein.

The Certificate of Acceptance of Nomination shall be filed

simultaneously with the Certificate of Nomination.

SECTION 6. Contents afld Eorrn of the Cefiificate of Nomination- -

The Certificate of Nomination of a PP, sectoral party, organization or
coalition shall contain the following:

a. Name of the PP, sectoral party, organization or coalition;

b. Name of the Chairperson/President/Secretary-General of the
nominating PP, sectoral party, organi zatton or coalition;
c. Names and Addresses of all the nominees;
cl. A certification that the nominees have all the qualifications and
none of the disqualifications provided by law and that they are not
candidates for any elective office for the May 12,2025 NLE and
BPE;
e. A clocumentary stamp in the amount of Thirty Pesos (Php30.00);

f. The signature and attestation under oath, either by the

Chairperson, President, Secretary-General of the nominating PP,
sectoral party, organization or coalition.

Onlv one documentary stamp is required which shall be attached to

the original copy of the Certificate of Nomination. The documentary stamp
tax number shall be written on the other copies of the Certificate of
Nomination. In case a documentary stamp of P30.00 is unavailable, two (2)
documentary stamps of P15.00 shall be attached to the Certificate of
Nomination.

The form of the Certificate of Nomination is attachecl as Annex "B".

SECTION 7. List of Nominees. - Each PP, sectoral party,

organization or Coalition shall nominate ten (10) nominees from which the
partyJist representatives shall be chosen in case it obtains the required
number of votes. The nominees shall be listed in the priority of preference
or ranking.

Nomination of less than ten (10) nominees shall not be accepted and
shall not be given due course by the Commission.

SECTION 8. Contents and Fonn of Certificate of Acceptance of

Nonrination of Party-List Groups. - The Certificate of Acceptance of
Nomination of a PP, sectoral party, organization or coalition shall contain
the following:

a. Nominee number;
b. Name of the nominee;
c. Name of the PP, sectoral Party, organizatton or coalitioni
d. Date and place of birth of the nominee;
e. Age;
f. Sex;
g. Civil Status;
h. Profession or occupation;
i. Address or residence;
j. Contactnumber;
k. Number of years residing in the Philippines immediately
preceding the election;
l. That the nominee is a natural-bom Filipino citizen;
m. That the nominee has executed a sworn renunciation of foreign
citizenship (if applicable);

n. That the nominee is not a permanent resident of, or an immigrant

to, a foreign country;
o. That the nominee is eligible for the office for which said nominee
is nominated;
p. That the nominee possesses all the qualifications and none of the
disqualifications provided by law;
q. That the nominee is not a candidate for any elective office for the
May "12,2025 NLE and BPE;
r. That the nominee will support and defend the Constitution of the
Republic of the Philippines and will maintain true faith and
allegiance thereto;
s. That the nominee will obey the laws, legal orders, ciecrees,
resolutions, rules and regulations promulgated and issued by the
duly constituted authorities;
t. That the nominee will abide by the rules and regulations of the
Commission, including its code of conduct on social media;
u. That the nominee shall not advocate violence or unlawful means
to achieve one's goals;
v. That the nominee gives consent to the Commission to collect,
clisclose or share, and process the personal data provided for
election and other lawful purposes in accordance with the Privacy
Notice and as may be authorized by existing laws;
w. That the nominee assumes the foregoing obligations voluntarily
without mental reservation or purpose of evasion;
x. That the facts stated in the certificate are true and correct to the
best of the nominee's personal knowledge;
y. Original signature of the nominee;
z. Passport-size photograph of the nominee taken within the last six
(6) months;
aa.A documentary stamp in the amount of Thirty Pesos (Php30.00).

Only one documentary stamp is required which shall be attached to

the original copy of the Certificate of Acceptance of Nomination. The
documentary stamp tax number shall be written on the other copies of the
Certificate of Acceptance of Nomination. In case a documentary stamp of
P30.00 is unavailable, two (2) documentary stamps of P15.00 shall be
attached thereto.

The form of the Certificate of Acceptance of Nomination is attached

as Annex "C".

SECTION 9. Affiitaoit of Qualificatiotts of Nominees. - The

Chairperson or President and Secretary-General of the nominating PP,
sectoral party, organization or coalition shall execute and file with the Law

Department, together with the CON-CAN, an affidavit attesting that the

nominees possess all the qualifications and none of the disqualif ications
provided by law.

The form of the Affidavit of Qualifications of Nominees /Substitute

Nominees is attached as Annex "D",

SECTION 10. Period and Place of Filing the Certificate

Notrrinatiorr and Certificate of Acceptance of Nontination of Party-List
Groups. - The CON-CAN and Affidavit of party-list groups shall be filed
from October 1., 2024 (Tuesday) to October 8,2024 (Tuesday), including
Saturday and Sunday, from 8:00 AM to 5:00 PM, before the Law
Department, copv furnished the Office of the Clerk of the Commission.

The CON-CAN and Affidavit of partyJist groups shall be filed

personally by either the Chairperson or President or in their absence, the
Secretary-General or by any authorized representative of the Nominating
PP, sectoral party, organization or coalition.

For this purpose, either the Chairperson, President or Secretary-

General shall present a duly notarized Secretary's Certificate or any
document, showing the formal declaration of the nominating PP, sectoral
party, organization or coalition of the authority to file the CON-CAN and
Affidavit.

If filed by an authorized representative of the nominating PP, sectoral

party, organization or coalition, the representative shall be required to
present along with the notarized Secretary's Certificate, a Sworn Authority
to Submit CON-CAN and Affidavit, containing the original signature of
either the Chairperson, President or Secretary-General of the nominating
PP, sectoral party, organization or coalition.

The Chairperson, President or Secretary-General or any authorized

representative of the PP, sectoral Party, organization or coalition may be
accompanied by a maximum of four (4) persons during the filing of the
CON-CAN and Affidavit. The presence of the respective nominees of the
party-list groups shall not be required.

The form of the Sworn Authority to Submit CON-CAN and Affidavit

is attached as Annex "E".

SECTION 11. Effects of Acceptance of Nomination. Nominees -

holding appointive or elective office may continue to hold office even after
acceptance of their nomination.

The one (1) year prohibition from being hired or rehired in a public
office after their partyJist organization fail to secure the needed votes to
qualify them for a seat in the House of Representatives, shall not applv to
them.

A public officer holding a public appointive office or position shall be

cleemed to include private citizens appointed to public offices representing
the private sector.

SECTION 12. Posting of Certificate of Nomination and Certificate

of Acceptance of Nomination of Party-List Groups - Starting October 18,
2O24 (Friday),The CON-CAN shall be posted at the website of the
Commission atutlttltt.conrclec.got,.ph in accordance with the Data Privacy Act
and its implementing rules and regulations.

The posting will serve as public notice of the nominees' declaration of

their qualifications as party-list representative. This is without prejudice to
the filing of appropriate petitions with the Clerk of the Commission
questioning the qualifications of the nominees.

For this purpose, the Law Department shall redact the personal
sensitive information of the nominee from the fourth copY of the CON-
CAN, scan the redacted CON-CAN into a PDF format, and save them in
accordance with the guidelines of the Commission.

SECTION 13. Preparation of the Certified List of Nominees. - The

Law Department shall prepare five (5) copies of the Certified List of
Nominees, not later than October 29, 2O24 (Tuesday) and submit it to the
Commission En Bmrc for its approval for publication.

SECTION 14. Nomination of Party-List Representatiaes. A -

person mav be nominated in one (1) list only. Only persons who have
given their consent in writing may be named in the list.

The list shall not include any candidate for any elective office for the

No change of names or alterations of the order of nominees shall be

allowed after the same shall have been submitted to the Commission,
except in cases where the nominee dies, becomes incapacitated, or there is a
valid withdrawal and substitution of nominees as provided in the
succeeding sections, in which case, the name of the substifute nominee
shall be placed last in the list.

SECTION 15. Withdrawal of Noninations and hfustittttion of

Party-List Nominees.- Withdrawal of nomination shall be in writing and
uncler oath, and filed with the Law Department up to mid-day of election
duy.

The substitution due to the withdrawal of the acceptance of the

nomination shall only be allowed not later than October 8,2024 (Tuesday)
and those filed beyond the said date shall not be given due course. No
substitution shall be valid unless the partyJist group files with the Law
Department a list of its substitute nominees, the CON-CAN of the
substitute nominees, and Affidavit of Qualifications of Nominees. The
number of nominees in the new list shall be the same with the number of
those previously submitted in the original list.

Nominees who withdraw their accePtance to the nomination shall

not be eligible for re-nomination by the same Party-list group or
nomination by other party-list groups.

SECTION \6, Substittttion of Party-List Nominees Due to Death or

Incapacity of the Substituted Nominees. - After October 8, 2024,
substitution of nominees due to death or incapacity shall be allowed only
up to mid-day of election day. Provided that no substitution shall be valid
unless the party files with the Law Department a list of its substitute
nominees, their CON-CAN and Affidavit of Qualifications of Nominees'
The name of the substitute nominee/s shall be placed last in the list.

The party-list group shall cause the publication of its new and
complete list of nominees in two (2) national newspapers of general
circulation within five (5) days from its filing with the Law Department.
The party-list group shall submit proof of publication of its list of
substitute nominees with the Law Department within three (3) days from
completion of said publication. No substitution shall be valid without
compliance with the requirements on publication and submission of proof
thereof.

In all cases where a nominee dies or becomes incapacitated, the party

shall file with the Law Department within ten (10) days from the fact
thereof a notice and proof of such death or incapacity.

After the election, even if the list of not less than ten (10) nominees is
exhausted, substitution of nominees shall no longer be allowed.

RULE III
PARTY REPRESENTATIVES
IN THE BARMM PARLIAMENT

LIST OF NOMINEES AND CERTIFICATE OF ACCEPTANCE OF

NOMINATION WITH AFFIDAVIT OF NON-AFFINITY OF
REGIONAL PARLIAMENTARY POLITICAL PARTY AND
COALITION

SECTION 77.Filing of List of Nominees and Certificate ,f

Acceptance of Nontination utith Affidaoit of Non-Affinity. -The List of
Nominees ancl Certificate of Acceptance of Nomination with Affidavit of
Non-Affinity of a Regional Parliamentary Political Party (RPPP) or
Coalition, shall be under oath and filed in nine (9) copies,' in the manner
prescribed by the Commission2 and in the form as herein prescribed.

The List of Nominees and Certificate of Acceptance of Nomination

with Affidavit of Non-Affinity shall be personally filed by either the
Chairperson or President or in their absence, the Secretary-General of the
RPPP or by any authorized representative of the Coalition.

For this purpose, either the Chairperson, President or Secretary-

General shall present a duly notarized Secretary's Certificate or any
document, showing the formal declaration of the nominating RPPP of the
authority to file the List of Nominees and Certificate of Acceptance of
Nomination with Affidavit of Non-Affinity.

If filed by an authorized representative of the nominating Coalition,

the authorized representative shall be required to present a Sworn
Authority to Submit List of Nominees and Certificate of Acceptance of
Nomination with Affidavit of Non-Affinity, containing the original
signatures of the appropriate officers of the respective parties that comprise
the Coalition.

The Chairperson, President or Secretary-General of the RPPP or

authorized representative of the Coalition may be accompanied by a
maximum of three (3) persons during filing and the presence of the
respecfive nominees of the party-list groups shall not be required.

The form of the Sworn Authority to Submit the List of Nominees and
Certificate of Acceptance of Nomination with Affidavit of Non-Affinity is
attached as Annex "F".

SECTION 78. Period and Place for Eiling of List of Nominees and
Certificate of Acceptance of Nomination utith Affidaait of Non-Affinity. -
The List of Nominees and Certificate of Acceptance of Nomination with
Affidavit of Non-Affinity of RPPP or Coalition shall be filed together with
the Manifestation of Intent to Participate in the Parliamentary Elections
(MIP-PE),3 not later than October 8, 2024 (Tuesday), with the Bangsamoro
Electoral Office (BEO), through the Bangsamoro Registration and
Accreditation Committee (BRAC), in accordance with the Bangsamoro
Election Code (BEC),4 Resolutions No. 10984, 109875 and 11004.

SECTION 79. Contents and Form of the List of Nominees. - Each

RPPP or Coalition shall nominate forty (40) nominees from which the party
representatives in the BARMM Parliament shall be chosen in case it obtains
the required number of votes. The nominees shall be listed in the priority
of preference or ranking.

The List of Nominees of RPPP or Coalition shall contain the

following:

a. Name of the RPPP or Coalition;

b. Name of the Chairperson/President/Secretary-General of the
nominating RPPP or in case of Coalition, the names of the
authorized representative of the Coalition;
c. Names, addresses and sex of the forty (40) nominees listed in the
prioritv of preference or ranking;
d. A certification that the nominees have all the qualifications and
none of the disqualifications provided by law and that they are not
canclidates for any elective office;

certification that the nominees of the RPPP or Coalition is
composed of at least thirty percent (30%) women;
f. The signature and attestation under oath, either by the
Chairperson, President, Secretary-General of the nominating RPPP
or any other duly authorized officer of the nominating Coalition;
g. A documentary stamp in the amount of Thirty Pesos (Php30.00).

The form of the Sworn List of Nominees under Comelec Minute

Resolution No. 24-02916 is amended and hereto attached as Annex "F-1".

SECTION 20. Contents and Form of Certificate of Acceptance of

Nomination with Affidaoit of Non-Affinity. - The Certificate of
Acceptance of Nomination with Affidavit of Non-Affinity of RPPP or
Coalition, shall contain the following:

a. Nominee number;
b. Name of the nominee;
c. Name of the RPPP or coalition;
d. Date and place of birth of the nominee;
e. Age;
f. Sex;
g. Civil status;
h. Profession or occupation;
i. Address or residence;
j. Contact number and e-mail address;
k. Number of years residing in the Philippines and BARMM up to
the day before the election;
l. That the nominee is a Filipino citizen;
m. That the nominee has executed a sworn renunciation of foreign
citizenship (if applicable);
n. That the nominee is not a permanent resident of, or an immigrant
to, a foreign country;
o. That the nominee is an active member of the RPPP or Coalitiory
and has not changed party membership within the last six (6)
months and not a member of any other RPPP;
p. That the nominee consented to be included in the List of
Nominees of the RPPP or Coalition for the PurPose of
participating in the BPE;
q. That the nominee's name does not aPPear in the list of nominees
of another party except in cases of coalition;
r. That the nominee is not related to any other nominee of the RPPP
or Coalition within the second degree of consanguinity or affinity;

s. That the nominee is eligible for the office for which said nominee
is nominated;
t. That the nominee possesses all the qualifications and none of the
disqualifications provided by law;
u. That the nominee will support and defend the Constitution of the

v. That the nominee will obey the laws, legal orders, decrees,
resolutions, rules and regulations promulgated and issued by the

bb. A documentary stamp in the amount of Thirty Pesos
(Php30.00).

The form of the Certificate of Acceptance of Nomination with

Affidavit of Non-Affinity under Comelec Minute Resolution No. 24-0291 is
amended and hereto attached as Annex "G".

SECTION 21. Effects of Acceptance of Nomination. - Nominees

holding appointive or elective office may continue to hold office even after
acceptance of their nomination.

A public officer holding a public appointive office or position shall be

deemed to include private citizens appointed to public offices representing
the private sector.

questioning the qualifications of the nominees.

For this purpose, the BEO shall redact the personal sensitive
information of the nominee from one of the duplicate copiesT of the List of
Nominees and Certificate of Acceptance of Nomination with Affidavit of
Non-Affinity, scan the redacted lists and certificates into a PDF format, and
save them in accordance with the guidelines set by the Commission.

SECTION 23. Encoding of the RPPP or Coalition and Norniflees

lnfornmtiort in tlrc Database. - the BEO, through the BRAC, shall:

a Using the program and format provided by the Information

Technology Department (ITD), encode the information of the
RPPP or Coalition and save the database in two (2) compact
discs (CDs) or USB drive.

b. Encode the information of the nominees into the excel file and
save it in two (2) CDs or USB drive. The format for the excel file
is attached as Annex "H".

The BRAC shall make sure that the information encoded are accurate
and complete as stated in the List of Nominees and Certificate of
Acceptance of Nomination with Affidavit of Non-Affinity.

SECTION 24. Deliaery of a Copy of the List of Nominees and

Certificate of Nonrinatiotr utith Affidaait of Non-Affinity to the Lau
Deparbnent and Election Recorils and Statistics Department and
Database. -
The two (2) duplicate copies8 of the List of Nominees and
Certificate of Acceptance of Nomination with Affidavit of Non-Affinity,
along with the four (a) CDs or USB drive containing the database of the

RPPP and Nominees, shall be delivered by the BEO to the Law Department
and Election Records and Statistics Department (ERSD), respectively, not
later than October 15,2024 (Tuesday).

SECTION 25. Preparation of the Certified List of Nominees. - The

Law Department shall prepare five (5) copies of the Certified List of
Nominees of RPPP of Coalition, not later than October 29,2024 (Tuesday)
and submit it to the Commission En Banc for its approval for publication.

SECTION 26. Nomination of Party Representatioe in tlrc BARMM

Parlianrcnt. - A person may be nominated in one (1) list onlv. Onlv persons
who have given their consent in writing may be named in the list.

The list shall not include any candidate for any elective office for the

No change of names or alterations of the order of nominees shall be

allowed after the same shall have been submitted to the Commission,
except in cases where the nominee dies, becomes incapacitated, or there is a
valid withdrawal and substifution of nominees as provided inthe
succeeding sections, in which case, the name of the substitute nominee
shall be placed last in the list.

SECTION 27. Withilrawal of Nominations anil Srtbstittttion of

Party Nornitrees in the BARMM Pailiament. - Withdrawal of nomination
shall be in writing and under oath, and filed personally with the BEO
through the BRAC up to mid-day of election day.

The substitution due to the withdrawal of the acceptance of the

nomination shall only be allowed not later than October 8,2024 (Tuesday)
and those filed beyond the said date shall not be given due course. No
substitution shall be valid unless the RPPP or Coalition files personally
with the BEO through the BRAC a list of its substitute nominees and the
certificate of Acceptance of Nomination with Affidavit of Non-Affinitv of
the substitute nominee. The name of the substitute nominee shall be placed
last in the list. Provided that the list shall be composed of at least thirty
percent (30%) women.

The number of nominees in the new list shall be the same with the
number of those previously submitted in the original list.

Nominees who withdraw their acceptance to the nomination shall

not be eligible for re-nomination by the same party or nomination by other
parties.

SECTION 28. Substitntionof Party Nominees Due to Death or

lncapacity of the Substituted Nominees. - After October 8, 2024,
substitution of nominees due to death or incapacity shall be allowed only
up to mid-dav of election day.

No substitution shall be valid unless the RPPP or Coalition files with

the BEO through the BRAC, the List of Substitute Nominees and Certificate
of Acceptance of Nomination with Affidavit of Non-Affinity of the
substitute nominees, provided that the list shall be composed of at least
thirty percent (30%) women.

The RPPP or Coalition shall cause the publication of its new and
complete list of nominees in two (2) newspapers of regional or
national/generale circulation within five (5) days from its filing with the
BEO through the BRAC. The RPPP or Coalition shall submit proof of
publication of its list of substitute nominees with the BEO through the
BRAC within three (3) days from completion of said publication. No
substitution shall be valid without compliance with the requirements on
publication and submission of proof thereof.

In all cases where a nominee dies or becomes incapacitated, the RPPP

or Coalition shall file with the BEO through the BRAC, within ten (10) days
from the fact thereof a notice and proof of such death or incapacity.

After the election, even if the list of nominees is exhausted,

substitution of nominees shall no longer be allowed

RULE IV
CERTIFICATE OF NOMINATION AND ACCEPTANCE
OF OFFICIAL CANDIDATES OF POLITICAL PARTIES AND
COALITIONS

SECTION 29. Filing of Certificate of Nomination anil Acceptance. -

The CONA shall be in the form prescribed by the Commission, under oath
and filed simultaneously with the Certificate of Candidacy (COC) in five
(5) copies.

SECTION 30. Contents and Fonn of Certificate of Nomination and

Acceptance. - The CONA of the aspirants of the duly registered PP or
Coalition shall contain the following:

a. Name of the PP or coalition;

b. Name and original signature of the authorized officer of the
nominating party;
c. jurisdiction or place of authority to sign the CONA by the
authorized officer of the nominating party;
d. Signature of the nominee.

If the aspirant is nominated by a registered PP or coalition, said

aspirant must submit a CONA from the registered PP or coalition, as the
case may be.

A sample form of the CONA is attached as Annex "I".

SECTION 37. Allowed Number of Nominations. - No duly

registered PP or coalition shall be allowed to nominate more than the
number of candidates required to be voted for in a particular elective
position, subject to the following guidelines:

a. tf the national authorized signatory or local authorized signatory

of a registered PP nominated more than the number of candidates
required to be voted for in a particular elective position, all of the
nominations shall be denied due course by the Commission, and
the aspirants shall be declared independent candidates.

b. In case two or more authorized signatories of a registered PP

nominated different candidates for the same elective position, the
aspirant nominated by the duly recognized atrthorized signatory
as identified in the Sworn List of Authorized Signatory of the
registered PP shalt be given due course by the Commission and
shall be declared as its official candidate. Any other aspirant
nominatecl by other authorized signatory shall be declared as an
independent candidate.

C If the national authorized signatory and local authorized signatory

of a registered PP nominated the same candidate for a particular
elective position, the nomination shall be given due course by the
Commission and the aspirant shall be declared as the official
candidate of the registered PP.

RULE V
FILING OF CERTIFICATES OF CANDIDACY

SECTION 32, Certificate of Candidacy - No person can run for the

position of Senator, Member of the House of Representatives or for any
Provincial, City or Municipal position, District Representative in the
BARMM Parliament, unless a sworn COC in the form herein prescribed for
the position aspired for, is accomplished and filed with the Commission

No person shall be eligible to run for more than one office to be filled
in the same election.

SECTION 33. Effect of Filing a Certificate of Canilidacy for More

than One Office. - An aspirant who files a COC for more than one office
shall not be eligible for any of them.

However, the aspirant may personally or through an authorized

representative, file with the proper Office not later than October 8,2024
(Tuesday), a sworn Statement of Cancellation to maintain the desired office
and cancel the COC for the other office or office/s.

SECTION 34. Contents and Fonn of Statement of Cancellation; if

Not Personallu Fileil. - The Statement of Cancellation shall be under oath
and shall state the following:

a. The date of filing of COC by the aspiranf

b. The name and consent of the nominating PP or coalition, if any;
c. The receiving office that received the COC of the aspirant;
d. The COC for the office/s to be cancelled by the asPiran!
e. The COC for the desired office to be maintained/retained by the
aspirant.

The Statement of Cancellation may be filed by an authorized

representative of the aspirant: Provided, That the authorized representative
shall present (i) valid Identification (ID) Cards of the aspirant and the
authorized representative; (ii) Authority to Submit Statement of
Cancellation, which must be under oath and signed by both the aspirant
and the authorized representative.

Sample forms of the Statement of Cancellation and Authority to

Submit Statement of Cancellafion are attached as Annex "1" arl.d "l-1",
respectively.

h . Citizenship, whether natural-born or naturalized;
i. The dulv registered PP or coalition to which the aspirant belongs,
if any; or in the case of party representative in the parliament, the
duly registered RPPP or coalition the aspirant belongs;
j Complete address for election purposes;
k. Residence, giving the exact address and the number of years
residing in:
i. The Philippines;
ii. Whenever applicable, the place where the aspirant intends to be
elected up to the day before the election;
l. The bnrangay, city, municipality and province where the aspirant is
a registered voter or will be a registered voter;
m. Profession or occupation or employment;
n. Active e-mail address of the aspirant, for notice and election
purposes;
o. That the aspirant is eligible for said office;
p. That the aspirant is not a permanent resident or an immigrant to a
foreign country;
q. That the aspirant has executed a sworn renunciation of foreign
citizenship (if applicable);
r. That the aspirant will file, with the Commission, within 30 days
after Election Day, a full, true and itemized Statement of
Contributions and Expenditures (SOCE) in connection with the
election;
s. That the aspirant will abide by the rules and regulations of the
Commission, including its code of conduct on social media;
t. That the aspirant shall not advocate violence or unlawful means to
achieve one's goals;
u. That the aspirant will support and defend the Constitution of the
Republic of the Philippines and will maintain true faith and
allegiance thereto;

v. That the aspirant will obey the laws, legal orders, decrees,
resolutions, rules and regulations promulgated and issued by the
duly constituted authorities;
w. That the aspirant assumes the foregoing obligations voluntarily
without mental reservation or purpose of evasion;
x. That the aspirant gives consent to the Commission to collect,
disclose or share, and process the personal data provided for
election and other lawful purposes in accordance with the Privacy
Notice and as may be authorized by existing laws;
y. That the facts stated in the certificate are true and correct to the
best of the aspirant's knowledge;
z. Whether the aspirant has been found liable for an offense/s which
carries with it the accessory penalty of perpetual disqualification
to hold public office, which has become final and executory.

Original signature over the printed name of the aspirant or digital

signature as defined under existing laws and rules.

Unless there was an official change of name through a court-

approved proceeding, an aspirant shall use in the COC:

a. the name registered in the Office of the Local Civil Registrar;

b. the name by which such aspirant has been baptized; or
c. anv other name under the provisions of existing law or in the case
of a Muslim, a Hadji name after performing the prescribed
religious pilgrimage.

When there are two or more aspirants for an office with the same
name and surname, each aspirant, shall need to state a paternal and
maternal surname, excePt the incumbent who may continue to use the
name and surname stated in the COC when last elected.

An aspirant may include one nickname or stage name bv which

aspirant is generally or popularly known in their locality: Provided, That
no aspirant shall use the nickname or stage name of another. Only one
nickname or stage name shall be considered.

An aspirant shall also affix a passport-size photograph taken within

the last six (6) months, and may attach a bio-data and program of
government not exceeding one hundred (100) words.

A P30.00 documentary stamp shall be attached to the COC- The

documentary stamp shall be attached to one (1) of the original copies of the
COC ancl the documentary stamp tax number shall be written on the
remaining four (4) copies of the COC. In case a documentary stamp of

P30.00 is unavailable, two (2) documentary stamps of P15.00 shall be

attached to the COC. The COC shall not be invalidated if all the copies
have attached documentarv stamps.

The COC shall be swom to before a notary public or any official

authorized to administer oath. Employees of the Commission are not
authorized to administer oath, even in their capacities as notary public.

In case of discrepancy or inconsistency in the five (5) copies of the

COC submitted, the copy in possession of the Law Department shall
prevail.

Aspirants must ensure that all items in the COC are filled out
completely, both in the front and back pages, in accordance with the
instructions stated therein. If in case certain item in the COC is not
applicable to the aspirants, they shall write N/A.

The forms of the COC are attached as Annexes "K" to 'K'9".

SECTION 36.Where to Eile Certificate of Candidacy. - Depending

on the elective positions aspired for, the COC shall be filed simultaneously
with the CONA, if applicable, in five (5) copies with the following

SECTION 37. Period
COC shall be filed on October "1, 2024 (Tuesday) to October 8, 2024
(Tuesday), including Saturday and Sunday, from 8:00 AM to 5:00 PM.
Provided, That, any person who files a COC within filing period shall only
be consiclered as a candidate at the start of the campaign period and
unlawful acts or omissions applicable to a candidate shall only apply upon
the start of the campaign period.

lf
at 4:45 PM during the period for filing of the COC, there are
aspirants inside the designated queuing area intending to file their
respective COCs, the Receiving Office shall:

a. Prepare a complete list, containing the names of the aspirants

inside the designated queuing area with completely filled-out
COCs. If the COC is not properly filled-out, the name of the
aspirant shall not be included in the list.
b. The names of the aspirants shall be consecutively numbered,
indicating the time of listing (queue time).
c. Announce the names of the aspirants, in the order in which they
are listed. Once name is called, the aspirant shall proceed with the
filing of COC. If the name of the aspirant is called beyond 5:00 PM
and fails to appear, the Receiving Office is authorized to refuse
acceptance of the COC at a later time.

The same procedure shall be observed if at 5:00 PM of the last day of

filing of the COC, there are still aspirants inside or within thirty (30) meters
from the designated queuing area.

Only the COCs of those whose names were listed by the Receiving
Office shall be accepted.

A COC filed in accordance with this procedure shall be stamped

"received" at the date and time it is actually filed and shall be deemed filed
on time. The signature of the receiving officer shall be affixed in the COC
once received.

An incomplete COC shall not be accepted and shall not be stamped

"received" on time even when the aspirant is present and waiting to be
called. A COC shall be deemed incomplete in the following instances: no

signature ns defned under existing laws and rules, not notaized COC, no
signnture of tlrc notary public, inconrplete address, no photograplL not completely
flled out COC.
The forms for the List of Aspirants in the Queuing/Waiting Area at
4:45 PM for the duration of the period for filing of COC and 5:00 PM of the
last dav for filing of COC, are attached as Annexes "M" and 'M:l',
respectively.

SECTION 38.Report on Non-Receipt of Certificate of Candidacy. -

The Receiving Office shall submit the list of aspirants whose COCs were
not received during the period for filing of COC, providing the reasons
therefor, and date when they were presented for filing.

If there is no instance of non-receipt of COC during the filing period,

this fact shall be indicated in the report.

The form of the Report on Non-Receipt of COC is attached as Annex

"N,

SECTION 39. Name to Appear on the Official Ballot, Contents. -

The name to appear on the official ballot of the aspirant shall contain the
following in such order: Aspirant's -

a. Surname/Last Name;
b. First name OR Nickname/Stage name; and
c. Acronym of the PP or coalition. If not a member of PP or coalition,
IND for independent.

Aspirants may use either their name or nickname/stage name/

together with the surname and acronym of the PP or coalition or IND for
independent.

The name to appear on the official ballot shall not exceed thirty (30)
characters. The count of the 3Q-character limitation includes spaces, letters,
numbers and punctuations.

a. The aspirant fails to indicate the name to appear on the official

d. There are multiple first names written, the totality of which,
together with the surname/last name and the acronym of the PP
or IND, exceeds the 30-character limit. In this case, the nickname
shall be included with the surname/last name and PP acronym or
IND as the Name to Appear on the Official Ballo!
e. There are multi-worded nicknames written, the totality of which,
together with the surname/last name and the acronvm of the PP
or IND, exceeds the 30-character limit. In this case, the first name
shall be included with the surname/last name ancl PP acronvm or
IND as the Name to Appear on the Official Ballot;
f. The name written is a combination of the first names and
nicknames or multi-worded first names or nicknames, the totality
of which, together with the surname/last name and the acronym
of the PP or IND, exceeds the 3O-character limitation. In this case,
only the name written first shall be included with the
surname/last name and PP acronym or IND as the Name to
Appear on the Official Ballot.

In the determination of the name to appear on the official ballot, the

Law Department may adopt the same name to appear used by the aspirant
in the previous elections.

SECTION 42. Posting of the Tentatiae List of Canilidates for

Purposes of the Name to Appear on the Official Ballot. - Starting October
29, 2024 (Tuesday), the tentative List of Candidates will be posted at the
website of the Commission at 7L,u,rL,.conrclec.gou.plr and at the offices where
the COCs are filed for purposes of checking the name to aPpear on the
official ballot.

Aspirants are encouraged to check their names to appear on the

official ballots for any clerical or typographical error.

SECTION 43. Last Day to File Request for Conection of Clerical or

Typographical Error on the Name to Appear on the Official Ballot. - ln
case there is clerical or typographical error in the name to appear on the
official ballot as posted in the website or at the COMELEC Offices, the

aspirant may personally file with Receiving/COMELEC Office concerned,

a request for correction of the clerical or typographical error not later than
November 8, 2024 (Friday). Any request filed beyond the deadline shall
not be entertained.

The Receiving/COMELEC Office will then forward the request to the

Law Department via electronic mail at lmt,[email protected].

No other entry in the name to appear on the official ballot shall be

changed or corrected except for clerical or typographical errors.

SECTION 44. E/fects of Filing of Certificate of Canilidacy. -

a. Any person holding a public appointive office or position,
including active members of the AFP, and other officers and
employees in government-owned or-controlled corporations, shall
be considered ipso facto resigned from the office and must vacate
the office at the start of the regular office hours of the day when
the aspirant filed the COC.

For purposes of the election of District Representatives in the

BARMM Parliament, the incumbent appointed members of the
Bangsamoro Transition Authority (BTA), whose Positions are
elective by nature, are not deemed ipso fncto resigned upon the
filing of their COCs. Those members of the Parliament who are
designated to positions in the Cabinet and other executive officers
are likewise not deemed resigned for the same reason.

b. Any person holding an elective office or position shall not be

considered resigned upon the filing of a COC whether for the
same or any other elective office or position.

SECTION 45.lndependent Candidate. - An independent candidate is

one who falls in anv of the following circumstances:

a. Who has not been nominated by a duly registered PP or coalition;

b. Whose CONA has been submitted by a PP or coalition not duly
registered with the Commission;
c. Who has not accepted a nomination, or has repudiated a CONA
from a duly registered PP or coalition not later than October 8,
2024 (Tuesday);
d. Who accepts nominations from more than one duly registered PP
or coalition for the same constituency;

e. Whose CONA is filed after the last day of filing of COC;

f. Whose CONA is for a position different from the position
indicated in the COC and has been discovered only after the last
day of the filing of the COC;
g. Whose CONA is cancelled, withdrawn or substituted by the
nominating party within the period for filing of COC, with the
conformity of the candidate;
h. Whose CONA is signed by a person whose authority to sign
CONA and specimen signature has not been submitted to the Law
Department within the period prescribed in these guidelines;
i. Who has submitted a CONA from the individual members of the
coalition, if nominated by a coalition;
j. Who has submitted a CONA not duly signed by the authorized
signatory of the PP or coalition; and
k. Such other grounds as may be determined by the Commission.

A CONA must come from the coalition, if the PP is a member of a

coalition.

An aspirant who accepts nominations from both national and local

registered PP shall not be considered as an independent candidate. In case
of nomination from both national and local registered PP, the following
guidelines shall be followed in the determination of the name of PP to be
reflected on the name to appear on the official ballot:

a. the choice of the aspirant shall prevail, unless it exceeds the 30-
character limitation;
b. if both the names of the national and local registered PP are
reflected in Item No. 4 of the COC, the name of the national
registered PP shall be reflected on the name to appear on the
official ballot;
c. If the name of the registered PP is not specified in Item No. 4 of the
COC, the name of the national registered PP shall be reflected on
the name to appear on the official ballot.

The choice of the aspirant shall likewise be considered in the

computation of the dominant majority and dominant minority PP.

SECTION 46. Ministerial Dttty of Receiaing anil Acknozoleilging

Receipt of Certificates of Candiilacy/l'lomination and Acceptance. - The
Receiving office has the ministerial duty to receive and acknowledge the
receipt of the COC and CONA: Provided, That they are filed in
conformity with these guidelines.

For this purpose, the Receiving Officer shall:

a. evaluate the COC and CONA, whether on their faces, thev

conform with these guidelines;
b. ensure that all five (5) copies of the COCs pertain to the same
office and are completely and properly filled-ouf

If properly and completely filled-out, each copy of the COC shall be

stamped "received" by the Receiving Office, indicating the date and actual
time of receipt. The Receiving Officer shall also affix a signature;

When any item of the COC, both in the front and back pages is left
unfilled, the Receiving Officer shall require the aspirant to complete and fill
out the item. In case the COC and CONA are filed by an authorized
representative of the aspirant, the Receiving Officer shall not receive the
COC and CONA and instead instruct the authorized representative to
inform the aspirant to complete and fill out the item left unfilled and file
the same before the end of the period for filing.

In any case, a COC that is not in the form prescribed by the

Commission for the position aspired for, incomplete, not signed or digitally
signed under existing laws and rules or filed beyond the prescribed period,
shall not be accepted.

Should the aspirant refuse to completely fill out all the items in the
COC, the Receiving Officer shall not accept the COC and CONA.

The Receiving Officer who fails to observe these guidelines shall

be held administratively liable.

SECTION 47. Recoding by the Receiaing Office of the Certificate of

Candidacy as Filed. - The Receiving Office shall maintain a log sheet and
record the following data, without leaving any space between entries:

a. Date and actual time of receipt;

b. Assigned consecutive number thereof;
c. Full name of the aspiran!
d. The office for which the aspirant is seeking election;
e. The nominating PP or coalition to which the aspirant belongs, if
any;
f. The number of copies actually received;
g. The name and signature of the duly authorized representative, if
the COC is not filed personally by the aspirant;
h. The name and signature of the Receiving Officer; and

Signature of the aspirant.

SECTION 48. Log Sheets of Certificate of Canilidacy as Filed. - The

Receiving Office shall observe the following guidelines for entering data in
the log sheets:

a. The data shall be recorded in chronological order as they have

been received.
b. Observe continuous numbering. The recording of data received on
the first and succeeding days should be numbered continuously.
Numbering should not be restarted.
c. The Receiving Officer shall record the data continuously on the log
sheet and may use extra sheets if necessary.
d. If a wrong entry is recorded, the Receiving Officer shall
strikethrough with a single line the wrong entry and affix a
signature.
e. The log sheet shall be closed on each day from October 1 to 8,
2024, at 5:00 PM or after the time allowed for the filing. To do so,
the Receiving Officer shall place a line immediately after the last
entry for each day and write the word "CLOSED".
f. The Receiving Officer and at least two (2) witnesses, if available,
shall affix their signatures immediately below the word "closed"
and indicate the date and exact time of closing.
g. In case no COC is filed on a specific date, the Receiving Officer
shall record this information in the log sheet by noting, "No COC
filed", and write the date and affix a signature.

The Receiving Office shall follow these guidelines for a systematic

and reliable pfocess and to facilitate easy tracking and verification of the
entries.

The form of Log Sheet is attached as Annex "O"-

SECTION 49. Submission of the Number of Aspirants Who Fileil

their Certificate of Candidacy.- On a daily basis, the PES shall:

a. Consolidate the daily reports submitted by the EO on the number

of aspirants who filed their COCs, indicafing the position aspired
for by sex; and
b. submit the daily reports to the ERSD through electronic mail at
[email protected] and copy furnish [email protected]'ph

The RED of NCR and BARMM and the EOs of Davao City and
Zamboanga City, shall likewise submit to ERSD, on a daily basis, through
electronic mail, the number of aspirants who filed their COCs, indicating
the position aspired for by sex.

The form of the Daily Report on the Number of Aspirants who Filed
their COC per Elective Position by Sex is attached as Annex "P".

SECTION S0.Watchers of Independent Aspirants, Political Parties

and Accredited Citizens' Anns. - An independent aspirant, PP or accredited
citizen's arm may appoint one (1) watcher each in connection with the filing
of the COCs. The watcher, who shall present an appointment paper to the
Receiving Officer, shall be allowed to stay within the premises of the
Receiving Office, subject to the guidelines herein set forth.

If all watchers cannot be accommodated in the area for filing of

COCs, preference shall be given to the watcher of the accredited citizen's
arm, dominant majority and dominant minority parties as determined by
the Commission in the May 9,2022 NLE.

Anv watcher may report to the Commission any irregularity

observed during the proceedings.

Watchers may secure from the Receiving Office, a copy of the full list
of those who filed their COCs and their respective positions for which they
intend to be elected.

SECTION 51.. Preparation of the List of Aspitants. - Immediately

after the last clav for filing of COCs, the following offices shall prepare a List
of Aspirants:

SECTION 52. Reports of the Certificates of Caniliilacy Receiaed. -

The Head of the Receiving Office shall:

a. Print a List of Aspirants as entered in the log sheet, affix a

signature thereon and submit it in PDF format, to the
Commission through the Law Department via electronic mail at
[email protected],.ph, not later than October 9, 2024
(Wednesday); and
b. Using the program and format provided by the ITD, encode the
aspirants information and save the database and generated
reports in two (2) CDs or USB drive. The Head of the Receiving
Office shall make sure that the aspirants' information encoded are
accurate and complete as stated in the COC.

SECTION 53. Posting the Certificate ,f Canilidacyand

Certificate of Nomination and Acceptance. - Starting October 78, 2024
(Friday), the COCs, including the CONAs, as may be applicable, shall be
posted at the website of the Commission v1l 71t7010.66111e1ec.go2'.ph, in
accordance with the existing policies under the Data Privacy Act and its
implementing rules and regulations.

The posting will serve as public notice of the aspirant's declaration of

qualifications for the position sought. This is without prejudice to the filing
of appropriate petitions with the clerk of the Commission to question the
qualifications of the aspirants.

For this purpose, the Receiving Officer shall redact the personal
sensitive informafion of the aspirant from the fourth copy of the COC and
CONA, scan the redacted certificates into a PDF format, and save them in
accordance with the guidelines set by the Commission.

SECTION 54.Distribution of Copies of Certificates of Candidacy. -

Copies of the COC and CONA shall be distributed as follows:

a. Original copy, to the Law Department;

b. Second copy, to the ERSD;
c. Third copy, to the aspirant; and
d. Fourth and Fifth copies, to the Receiving Office concerned.

SECTION SS.Withitrazoal of Certificate of Candiilacy. - An aspirant

may personally file, at any time before Election Day and subject to the

guidelines herein, a sworn Statement of Withdrawal, in five (5) original

copies, with the Office where the COC is filed.

No Statement of Withdrawal filed by a person other than the aspirant

or if filecl by mail, electronic mail, or facsimile shall be accepted.

The RED, PES or the EO concerned, upon the receipt of the sworn
Statement of Withdrawal, shall notify the Law Department of the said
withdrawal, through electronic mail at [email protected]'.ph, stating the
following:

a. Name of the withdrawing aspirant;

b. Position aspired for; and
c. Nominating PP or coalition of PP, if any.

on the same day, the Receiving officer shall immediately forward to

the Law Department, two (2) original copies of the sworn Statement of
withdrawal. The Law Department shall, in turn, forward one (1) original
copy to the ERSD.

The clistribution of the remaining copies of the sworn Statement of

Withdrawal shall be the same as the distribution of COCs under Section 54
hereof.

The filing of a sworn Statement of Withdrawal of a COC shall not

affect whatever civil, criminal or administrative liability an aspirant may
have incurred.

SECTION S7.Eiling of Statement of Withdtazoal by the Duly

SECTION SS.lnability to Sign anil Swear to the Statement of

Withdrawal Due to Serious Medical Condition. - In case the aspirant is
physically unable to sign and swear to the Sworn Statement of Withdrawal
due to a serious medical condition, an appropriate petition for the
withdrawal of candidacy may be filed with the Clerk of the Commission
for the consideration of the Commission En Banc.

SECTION 59. Substitution due to the Withdrau,al of the Original

Aspirant. - Substitution due to the withdrawal of the original aspirant shall
onlv be allowed until October 8,2024 (Tuesday).

In this case, the sworn Statement of Withdrawal shall also include the
name of the substitute.

No substitute shall be allowed for any independent candidate.

No substitution shall be valid unless the substitutes file with the

Receiving Office, their COC and CONA.

The Receiving office shall act on all sworn statements of withdrawal

and substitution of aspirants filed from October '1,2024 to October 8,2024.
Proviclecl that the COC and CONA and Sworn Statement of Withdrawal
shall be delivered to the Law Department and ERSD in accordance with
Sections 54 and 55 of this Resolution.

SECTION 60. Substittttion of Aspirants/Candiilates in Case of Death

and Disqualification of the original Aspirant/Candidate. - An aspirant of
a dulv registerecl PP or coalition who died or is disqualified for any cause
may be substituted by an aspirant belonging to, and nominated by, the
san're PP or coalition.

No substitute shall be allowed for any independent candidate.

The substitutes of the original candidates who died or were

clisqualifiecl for any cause, may file a COC and CONA for the office

affected on or before November 15, 2024 (Friday) to have their name

included on the official ballots.

After November 15, 2024, the substitute of the original

aspirant/candidate who died or was disqualified by final judgment, may
file a COC up to mid-day of ElecLion Day: Provided, That the substitute
shares the same sumame as the original aspirant/candidate.

The substitute must possess all the qualifications and none of the
rlisqualifications provided by law for the office affected. The substitute of
the original aspirant/candidate who died shall submit the certified true
copy of the Death Certificate of the original aspirant/candidate.

If the death or disqualification should occur between the day before

the election and mid-day of Election Day, the substitute may file a CoC
with any of the Electoral Board, EO, PES or RED, as the case may be, in the
politicai subdivision where the person is a candidate, or in the case of a
candidate for Senator, with the Law Department.

The Law Department is authorized to act on all swom statements of

Withdrawal and substitution in case of death or disqualification of the
original candidate for local position. All actions of the Law Department
shill remain valid and effective unless otherwise reversed or set aside by
the Commission.

All sworn statement of withdrawal and substitution of candidates

for national positions filed with the Law Department shall be submitted to
the Commission En Bnnc for resolution.

SECTION 63. Lack of Documentary Stamp Aaailability. - lf a

document stamp is not available, the tax may be paid through the
Treasurer's Office, other Authorized Agent Banks (ABB) within the
territorial jurisdiction of the Revenue District Office (RDO) where the
aspirant-taxpayer is a registered voter, or other electronic payment (IPAY)
facilities including that of the Landbank of the Philippines (LBP),
Development Bank of the Philippines' (DBP), Union Bank of the
Philippines (UBP) and Taxpayer Software Provider (TSP). In which case,
the official receipt (OR) shall be attached to the original COC, CON-CAN
and Certificate of Acceptance of Nomination with Affidavit of Non-
Affinity, and the OR number shall be written on all the copies thereof'

SECTION 64. Transmittal of Doatments to the Political Einatrce

and Affairs Department. - All COCs, CONA, CON-CAN, List of Nominees
and dertificate of Acceptance of Nomination with Affidavit of Non-
Affinity, as well as the statements of withdrawal submitted to the Law
Depariment shall be forwarded to the Political Finance and Affairs
Department (PFAD) not later than )une 30,2025 (Monday)'

These documents shall be used by the PFAD in connection with the

evaluation of the campaign expenses of candidates for the May 12,2025
NLE and BPE.
