About This Template

Below you'll find my self-petitioned EB1A Green Card Template. The source template is derived from that of Razvan Marinescu who was the inspiration for me to self-petition my own EB1A green card. I would recommend you check out my blogpost as well as Razvan's before you start working with this template directly. You may also be interested in the questions and comments on the following Reddit post.

Installation

You may either clone the repo on the command line via:

git clone [email protected]:Ryan-Rhys/EB1A.git

or you may simply download the zipped folder from GitHub and re-upload it to Overleaf.

Remember: This template is a REFERENCE ONLY. Have an attorney review anything you submit to USCIS.

Here I have included a full template for the I-140 component of the EB1A application. Once my I-140 was approved I needed to submit the applicaton to register permanent residence, the I-485, separately. I chose to submit the forms separately as opposed to concurrently to save time in case the I-140 application was rejected. This template includes:

  • Completed, anonymized administrative forms (I-140, G-1125, I-907)
  • I-140 is the immigrant petition for alien workers
  • I-907 is the request for premium processing
  • G-1145 is the E-notification of application/petition acceptance
  • The LaTeX file for the petition in petition.tex
  • The pdf for the petition in petition.pdf
  • Completed, anonymized reference letters in the reference_lettersfolders
  • Auxiliary exhibits in the aux folder
  • Further information on the journals I reviewed for in the review_journal folder

CRITICAL WARNINGS:

  1. Forms change frequently. These may be outdated. Always use current form versions from USCIS.gov

  2. Every case is different. How I completed these forms may not be appropriate for your situation.

  3. Form instructions change. USCIS updates instructions regularly. Don't rely on how I completed forms in 2023.

  4. Filing fees change. The fees I paid in 2023 are different now.

Frequently Asked Questions

Q: Can I use this template to file my own EB-1A petition?

A: You can, but you shouldn't without attorney review. While self-petitioning is legal, immigration law is complex and changes frequently. Most people benefit significantly from attorney guidance. At minimum, have an attorney review your petition before filing (rough estimate of consultation cost is $100-$300).

Q: Will using this template guarantee my EB-1A approval?

A: Absolutely not. My petition was approved in 2023, but that doesn't mean yours will be. USCIS approval depends on many factors:

  • Your specific qualifications and evidence
  • Current USCIS policies (which change frequently)
  • How well your petition is tailored to YOUR situation
  • The adjudicating officer's interpretation
  • Changes in law or policy since 2023

Q: Is this template current?

A: No. This template is based on my 2023 petition. Immigration law and USCIS policies may have changed since then. You MUST verify current requirements by checking official USCIS resources or with an attorney.

Q: Do I qualify for EB-1A?

A: I cannot assess your eligibility. That's a legal determination that only an immigration attorney can make after reviewing your specific qualifications. Please consult an attorney for an eligibility assessment.

Q: Can you help me with my specific case?

A: No. I am not an attorney and cannot provide legal advice or assistance with your specific case. Please consult a licensed immigration attorney.

Q: Can you review my petition draft?

A: No. Reviewing petitions and providing feedback would constitute legal advice, which I am not qualified to provide. An immigration attorney can review your petition.

Q: How much did you spend?

A: My costs were approximately:

  • Attorney review: $200
  • I-140 filing fee: $700 (check current fee)
  • I-907 premium processing: $2,500 (check current fee)
  • FedEx shipping: ~$50

Note: These were 2023 prices. Fees change. As of November 2025 the I-140 filing fee is $715 and there is an additional asylum program fee for self-petitioners of $300 (https://www.uscis.gov/g-1055?form=i-140)

Q: Should I self-petition or hire an attorney?

A: This is a personal decision that depends on:

  • Your comfort with legal processes
  • Complexity of your case
  • Your available time and resources
  • Current immigration climate
  • Risk tolerance
