If we are to be persnickity (and we should be) the favouring a leg poll very effectively demonstrates the truth of the situation, which is that both answers are correct; the term is used both ways in modern English, regardless of etymology or historical usage.
I'm going to take the radical approach that neither option is correct anymore. You have no clue if you are talking to someone in the 60% or the 40%, thus rendering it an inherently unusable method of communication.
