Bought a Ford Kuga last month, only to find out after 3 weeks that the car had an outstanding safety recall notice and was not supposed to be sold or used for demonstration purposes making it unsellable, I was told when I complained and asked for a full refund as was my right under the consumer rights act 2015, the after sale manager claimed that they did not apply to my case and that they buy and sell cars all the time with outstanding recalls on them and they will sell my car straight away, and after offering me just £19200 to buy it back, after paying £21200 for the extended warranty and guard ex they purchased my car back for £19500 after I eventually relented and accepted as I just wanted to end the whole terrible experience, then after speaking to Ford customer relations and looking on the DVSA website it clearly stated it was illegal to sell a car with an ongoing safety recall notice, which in the case of my car had no fix as the software was still being developed, and what made matters worse the manager then lied and claimed that it had only just become apparent on the 26th of March and when I purchase the car it had a clean bill of health on the 5th of March, after doing some research this car model had carried this recall notice as far back as 2022 and then attempted software updates to fix the problem were unsuccessful resulting in the notice remaining in place, I have now escalated my case to the Motor Ombudsman and through Ford customer relations department.
